Want to hire Indian workers in UAE? You can no longer recruit directly

If you are looking to hire Indian workers in the UAE, there is a set of new procedures in place that need to be adhered to for bringing workers from India into this country.

According to Embassy of India in Abu Dhabi, all foreign employers who seeks to recruit Indian workers now need to register with the eMigrate system (www.emigrate.gov.in). The registration application will then be vetted by the Indian Mission before any foreign employer is allowed to proceed further with the hiring process.

After the potential employer is vetted by the mission as per the rules outlined, foreign employers will have to then raise the demand for Indian workers on the eMigrate system and seek a permit to recruit themselves or select recruiting agents in online manner.

“Such foreign employers shall be required to declare the terms and conditions of employment of each category of the job at the time of applying for the demand registration,” the embassy said in a statement.

“The declared terms and conditions of employment will act as a specimen contract and will form the part of employment contract at the time of actual recruitment. The procedure to fill the online form has been explained on the website,” the statement added.

The biggest recruiters in the UAE will be the first ones to be impacted by this system. The embassy specifies that employers looking to hire more than 150 Indian workers are required to register online with immediate effect in order to raise demand and seek a permit to recruit directly or select registered agencies.

Such employers may include construction firms and large supermarket chains, among others.

For those who are looking to employ between 50-150 Indian workers, the deadline to register online has been set before June 30, 2015.

Employers recruiting between 20-50 Indian workers are required to do the needful before July 31, 2015 and for those looking to hire less than 20 Indian workers get the maximum levy and are required to register online before August 31, 2015.

The embassy noted that, for foreign employers who wish to recruit Indian workers directly, a provision for applying for permit from Registering Authority in Ministry of Overseas Indian Affairs is available online. However, they can do so only after getting registered in the eMigrate system with immediate effect.

The new rules are applicable for Indian workers with an ECR (Emigration Clearance Required) stamp on their passports, a set of blue-collared workers that is estimated to be more than 40 per cent of the 2 million-plus Indians working in the UAE.

The new ruling does not mention about domestic help, drivers and nannies that are hired by individuals.
